The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:

The TruFreeze Spray Cryotherapy machine is only produced by Steris. There is not another source for this type of Cryotherapy. This Cryotherapy machine allows the Physicians to spray Liquid Nitrogen on to an area to treat possible cancerous cells and tissue deformity. This can be used by our GI physicians in the Gi tract and also by our Pulmonary physicians in the lungs. This machine is unique in that the Cryo can be sprayed on to tissue. All other types of Cryotherapy machines use a probe that is applied to the site and freezes the tissue by touch. This Cryotherapy procedure is used in place of RFA treatment which is the process of burning and scraping the possible effected tissue. Cryotherapy treatment can be used if there are no results with RFA treatment and can also be a good alternative to RFA with it being less painful treatment and a shorter recovery time.

This sole source will be valid for a one time purchase with a cost that will exceed $50K.
