The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:
The University of Utah utilizes Comcast XOC services to provide content to all student housing (HRE and Sunnyside); University venues (Rice Eccles stadium, Huntsman arena, etc.); University administrative offices, various colleges and departments. The service has been customized to meet the needs of each client.
There are very few vendors that specialize in university housing. Through market research, most carriers don't offer the breadth of services that we require. For instance, one vendor that was contacted provides TV service, but the service offering is limited to 72 channels and we would not be able to get all necessary sports channels. No DVR and no off campus streaming. Our current solution allows 20 hours of DVR, all necessary sports channels, and let's students stream content off campus. Our current solution also provides 6 inline channel insertion. One of the channels is configured for ultra low latency and is used in our sports venues. No other single vendor provides all the features that we currently utilize.
